Welcome to HERO - Leben in Deutschland (the “App”). The App is developed and published by an independent developer as an educational tool to help users prepare for the “Leben in Deutschland” / Einbürgerungstest (naturalization test).
This App is intended solely for educational purposes. It is not an official product of, nor affiliated with, nor endorsed by the Federal Office for Migration and Refugees (Bundesamt für Migration und Flüchtlinge, BAMF) or any other governmental authority.
By downloading, accessing, or using the App, you agree to be bound by these Terms of Use. If you do not agree, you must not use the App.
2.1 Grant of License
Subject to your compliance with these Terms of Use, the developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, strictly for your personal, non-commercial, educational use.
2.2 Restrictions
You agree not to, and you must not permit others to:
(a) copy, modify, adapt, translate, distribute, sell, lease, lend, sublicense, or otherwise exploit the App or its content for commercial purposes;
(b) reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, or underlying structure of the App, except to the limited extent permitted by applicable mandatory law;
(c) remove, obscure, or alter any copyright, trademark, or other proprietary rights notices contained in the App;
(d) use the App in any unlawful manner, or in violation of these Terms, or in a way that infringes the rights of any third party;
(e) use the App to develop or distribute malicious software or to disrupt, damage, or interfere with the proper functioning of the App or any systems of third parties.
2.3 Reservation of Rights
All rights not expressly granted to you under these Terms remain reserved by the developer. Nothing in these Terms transfers to you any ownership of intellectual property rights in or to the App, its content, or any associated materials.
2.4 Updates
The developer may, at their sole discretion, provide updates, upgrades, or modifications to the App. These Terms will govern any such updates unless accompanied by separate terms. The developer is not obligated to provide support, maintenance, or continued availability of the App.
2.5 Termination of License
The license granted herein will terminate automatically without notice if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
3.1 No Official Status
The App is an independent educational tool created for practice and preparation purposes only. It is not an official product of, nor affiliated with, nor endorsed by the Federal Office for Migration and Refugees (Bundesamt für Migration und Flüchtlinge, BAMF) or any other governmental authority.
3.2 No Guarantee of Accuracy
While the developer strives to provide up-to-date and accurate content, the App may contain errors, omissions, or outdated information. The content of the App does not replace official study materials published by BAMF or other authorities.
3.3 No Guarantee of Results
The App is designed to support users in preparing for the “Leben in Deutschland” test. However, the developer makes no warranty or guarantee that use of the App will result in passing the test, obtaining citizenship, or achieving any particular outcome.
3.4 User Responsibility
Users are solely responsible for verifying information with official sources and for making all necessary preparations for the test. The developer accepts no liability for any consequences arising from reliance on the App, including but not limited to exam failure, delays in application processes, or other personal, legal, or administrative consequences.
4.1 No Account Required
Use of the App does not require user registration or the creation of an account. Users may access and use the App without providing login credentials.
4.2 Optional Data
The App may allow users to enter optional information (such as preferred language, test location, or test date) to customize their learning experience. This information is stored only locally on the user’s device and is not used to create or maintain a personal account.
4.3 User Responsibility
You are responsible for the security of your device and for ensuring that any data entered into the App is accurate. The developer does not verify, control, or back up this information.
5.1 Free Use with Ads
The App may be downloaded and used free of charge. Free use may include the display of advertising content provided by third parties.
5.2 In-App Purchases
The App offers optional paid features, including but not limited to ad removal, monthly subscriptions, and one-time purchase options. All payments are processed securely through the Apple App Store in accordance with Apple’s terms and conditions. The developer does not directly handle or store payment information.
5.3 Billing and Renewal
(a) Subscriptions will automatically renew at the end of each billing cycle (e.g., monthly) unless canceled before the renewal date.
(b) One-time purchases grant permanent access to the purchased feature without recurring charges.
(c) Prices may vary depending on region and currency, as determined by the App Store.
5.4 Refunds
All refund requests are handled exclusively by the Apple App Store under its refund policies. The developer has no ability to issue refunds directly. Users seeking refunds must submit their request through the App Store.
5.5 Changes to Pricing
The developer reserves the right to change pricing for in-app purchases at any time. Any changes will apply prospectively and will not affect purchases already completed.
6.1 Advertising
The free version of the App may display advertisements provided by third-party ad networks. These advertisements are not controlled by the developer. The appearance, content, and accuracy of such advertisements are the sole responsibility of the third-party providers.
6.2 Third-Party Content and Links
The App may include links to websites, services, or content provided by third parties. The developer does not endorse, control, or guarantee the accuracy, legality, or quality of any third-party content. Accessing or using third-party content is at your own risk.
6.3 No Liability for Third Parties
The developer shall not be liable for any damages, losses, or issues arising from your interactions with third-party advertisers, websites, or services, including but not limited to purchases, promotions, or reliance on third-party content.
6.4 User Responsibility
You are solely responsible for reviewing and complying with the terms and privacy policies of any third-party websites or services accessed through the App.
7.1 Ownership
All rights, title, and interest in and to the App, including but not limited to the software, code, design, artwork, graphics, logos (including the hand-drawn logo), user interface, text, and other content, are and shall remain the exclusive property of the developer or its licensors.
7.2 Trademarks
The name “HERO – Leben in Deutschland” and associated logo are used in connection with the App. Nothing in these Terms grants users any right or license to use the developer’s trademarks, trade names, or logos without prior written permission.
7.3 Third-Party Materials
The App may incorporate or display third-party materials (including fonts, wording, or open-source elements). Such materials remain the property of their respective owners. If you believe your intellectual property has been used in a way that constitutes infringement, please contact the developer at the email provided in Section 14. The developer will investigate and, if appropriate, remove or replace the material.
7.4 Restrictions
Users may not copy, reproduce, distribute, or create derivative works from the App or its content except as expressly permitted by these Terms.
7.5 Reservation of Rights
All rights not expressly granted under these Terms are reserved by the developer.
8.1 General Restrictions
You agree not to use the App for any purpose that is unlawful or prohibited by these Terms. Without limiting the generality of the foregoing, you must not:
(a) use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other user’s use of the App;
(b) attempt to gain unauthorized access to the App, its systems, or networks;
(c) upload, transmit, or distribute any viruses, malware, or other harmful code;
(d) use the App to infringe the rights of others, including intellectual property, privacy, or data protection rights;
(e) use the App for fraudulent, deceptive, or misleading purposes;
(f) reproduce, duplicate, copy, sell, trade, or resell the App or its content for any commercial purpose without express prior written permission from the developer;
(g) circumvent or attempt to circumvent any security or technical limitations of the App.
8.2 Legal Compliance
You agree to comply with all applicable laws, rules, and regulations of Germany, the European Union, and any other jurisdiction relevant to your use of the App.
9.1 As-Is Basis
The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. The developer disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement, to the fullest extent permitted by law.
9.2 No Liability for Specific Outcomes
The developer shall not be liable for:
(a) your performance or results on the “Leben in Deutschland” / Einbürgerungstest;
(b) any errors, omissions, or inaccuracies in the App’s content;
(c) exam failures, delays in application processes, or denial of citizenship or residence rights;
(d) any reliance you place on the App or its content.
9.3 Indirect and Consequential Damages
To the fullest extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of opportunities, even if advised of the possibility of such damages.
9.4 Maximum Liability
To the extent liability cannot be excluded under applicable law, the developer’s total cumulative liability arising out of or in connection with the App shall not exceed the amount actually paid by you (if any) for use of the App during the twelve (12) months preceding the event giving rise to the claim. If you have only used the free version of the App, the developer shall have no liability beyond what is required under mandatory law.
9.5 Consumer Rights
Nothing in these Terms affects any mandatory consumer rights under German or EU law that cannot be waived or limited by contract.
Your use of the App is also governed by the Privacy Policy, which explains how the developer collects, uses, and protects personal data in accordance with the General Data Protection Regulation (GDPR). By using the App, you agree to the processing of your data as described in the Privacy Policy.
11.1 Right to Terminate
The developer may suspend or terminate your access to the App, in whole or in part, at any time and without notice, if you:
(a) violate these Terms of Use;
(b) misuse the App or use it in a manner that may cause harm to the App, the developer, or other users;
(c) engage in unlawful activities in connection with the App.
11.2 Effect of Termination
Upon termination, the license granted to you under Section 2 shall immediately cease, and you must delete all copies of the App from your devices.
11.3 No Liability for Termination
The developer shall not be liable to you or to any third party for suspension or termination of your access to the App, provided such action is taken in accordance with these Terms.
11.4 Survival
Any provisions of these Terms which by their nature should survive termination (including but not limited to Sections 7 (Intellectual Property), 8 (Prohibited Uses), 9 (Limitation of Liability), 13 (Governing Law), and 14 (Contact Information)) shall remain in full force and effect after termination.
12.1 Right to Modify
The developer reserves the right to modify, amend, or update these Terms of Use at any time to reflect changes in law, technology, App functionality, business practices, or other relevant reasons.
12.2 Notification of Changes
Material changes will be communicated to users by reasonable means, which may include a notice within the App, an update through the App Store, or an update on the official website.
12.3 Acceptance of Changes
By continuing to use the App after the updated Terms take effect, you agree to be bound by the revised Terms. If you do not agree to the revised Terms, you must stop using the App and delete it from your device.
13.1 Applicable Law
These Terms of Use and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law rules.
13.2 Consumer Protection
If you are a consumer residing in the European Union, you may also benefit from the mandatory provisions of the law of your country of residence. Nothing in these Terms shall affect your rights as a consumer under applicable EU or local law.
13.3 Jurisdiction
The courts of the developer’s residence in Germany shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms, unless applicable mandatory consumer law provides otherwise.
